1. Definitions

1.1 "Data Protection Laws" means the Protection of Personal Information Act, 4 of 2013 and any other applicable laws relating to privacy and the processing of Personal Information in the Republic of South Africa;

1.2 "Green Media" / "we" / "us" / "our" means Green Media (Pty) Ltd (registration number 2021/946681/07), a limited liability company incorporated in the Republic of South Africa;

1.3 "Personal Information" has the meaning given to it in the Protection of Personal Information Act, 4 of 2013;

1.4 "Process" has the meaning given to it in the Protection of Personal Information Act, 4 of 2013 and derivative terms such as "Processing" or "Processed" will have the same meaning;

1.5 "Website" means www.mediacredits.co.za;

1.6 "you" / "your" means the user of the Website and/or the company or entity the user represents, where applicable.

2. Collection and Processing of Personal Information

2.1 Through your access to and/or use of the Website, you may provide us with Personal Information and/or we may collect Personal Information from you. You hereby agree to the terms and conditions set out in this Privacy Policy and you consent to us collecting and Processing your Personal Information and other data, for the purposes set out herein.

2.2 Green Media makes use of cookies on the Website, certain of which cookies may amount to Personal Information and further details in respect of cookies are included in our cookie policy. We may also collect publicly available Personal Information on you.

2.3 We recognize the importance of protecting your privacy in respect of Personal Information collected by and/or provided to us during your access to and/or use of the Website and the related products and/or services accessed through the Website.

2.4 You acknowledge and agree that, if you (or the company or entity you represent) have entered into a subscription agreement and/or trade exchange agreement(s) with Green Media, the terms of this Privacy Policy will apply together with the terms of the aforementioned agreements. In the event of a conflict between the terms of the aforementioned agreements and the terms of this Privacy Policy:

2.4.1 the terms of this Privacy Policy will prevail in respect of your access to and use of the Website; and

2.4.2 the terms of the aforementioned agreements will prevail in respect of trade exchanges between you (and/or the company and/or entity you represent) and Green Media, including in respect of the products and/or services provided by you (and/or the company and/or entity you represent) to Green Media and by Green Media to you (and/or the company and/or entity you represent), in terms of such trade exchanges.

2.5 The types of Personal Information and other data that we may collect from you include information necessary for our legitimate business interests, including making the Website available to users thereof, and further including the following:

2.5.1 Your name, surname, email address, contact number; and

2.5.2 Company name, job designation.

2.6 The purpose for which Green Media will use and Process your Personal Information collected by us and/or provided by you to us is to:

2.6.1 provide you with access to and use of the Website;

2.6.2 provide you with products and/or services of Green Media and/or third parties;

2.6.3 respond to your enquiries and to communicate with you;

2.6.4 verify your identity;

2.6.5 exercise our rights and/or perform our obligations in terms of any separate agreement(s), including trade exchange agreement(s) entered into between you and us;

2.6.6 inform you of new features and special offers of Green Media and other marketing messages and material;

2.6.7 assist us in any future dealings with you and to generally improve your experience in respect of the Website and/or other products and/or services of Green Media and/or third parties; and

2.6.8 contact you to advise you that we have changed or are about to change certain terms and conditions set out herein and/or the products and/or services offered via the Website and/or the terms applicable to the aforementioned products and/or services.

2.8 Sharing and Disclosure of Personal Information

2.8.1 You hereby acknowledge and agree that:

(a) you must not share any information with Green Media that you do not wish Green Media to share with third parties involved in the provision of (i) the Website, (ii) the products and/or services of Green Media and/or (iii) products and/or services of third parties provided by Green Media, and matters ancillary thereto;

2.8.2 Green Media will be entitled to disclose your Personal Information to any personnel, representatives, agents, professional advisors, suppliers and/or other third parties appointed by Green Media and involved in (i) the Website, (ii) the business and/or products and/or services of Green Media, and/or (iii) the products and/or services of third parties supplied by Green Media, and/or (iv) assisting Green Media in Processing your Personal Information.

2.8.3 Subject to paragraph 2.8.1 above, we will not Process, use or disclose your Personal Information to third parties without your consent, unless the Processing, use or disclosure is:

2.8.4 required in order for us to comply with applicable law, order of court or legal process served on Green Media; and/or

2.8.5 disclosure is necessary to protect and defend our rights or property.

2.9 We will comply with applicable Data Protection Laws in respect of your Personal Information and will take appropriate technical and organisational measures to protect your Personal Information provided to us and/or collected by us in relation to the security thereof and protection against unauthorised or unlawful Processing, accidental loss, destruction or damage, alteration, disclosure or access. We do not, however, warrant or guarantee that such unauthorised or unlawful Processing, accidental loss, destruction, damage, alteration, disclosure or access will never occur.

2.10 You may request access to the Personal Information provided by and/or collected from you, including to edit and/or rectify the information, or object to its Processing by sending an email to us at [email protected] (or any other address indicated from time to time on the Website).

2.11 You acknowledge and specifically agree that we may, from time to time, Process your Personal Information on servers outside of South Africa. In particular, you consent to the cross-border transfer of the Personal Information shared with Green Media through your use of the Website outside South Africa for the purpose of Green Media's legitimate business interests, including making the Website available to users thereof.

2.12 To the extent that any provision of this Privacy Policy is regulated by or subject to Data Protection Law, it is not intended that any provision contravenes such Data Protection Law. All provisions of this Privacy Policy must be treated as being qualified, to the extent necessary, to ensure compliance with applicable Data Protection Law.
